The instrument

Portuguese public procurement is governed by the Public Contracts Code (Código dos Contratos Públicos), enacted as an annex to Decree-Law 18/2008 of 29 January. The Code was substantially amended by Decree-Law 177/2026 of 4 September, published in Diário da República, 1st series, no. 172. The amending instrument alters approximately two hundred articles, adds thirty-four new ones, repeals a significant body of provisions — including articles 2 to 16 of Law 30/2021 — and republishes the Code in full as an annex.

The reform applies to award procedures commenced on or after 1 October 2026 (articles 10(1) and 11). Two matters, however, apply to procedures under way and to contracts already in performance: objective modification of the contract and alternative dispute resolution (article 10(2)).
