Municipalities are the most numerous contracting authorities in Portugal and the most affected by the 2026 reform. They gained higher thresholds, a new five-invitee procedure and wide procedural discretion — each of which now requires written justification.
Context
A municipality is not a contracting authority like any other. It has dispersed organisational units, decentralised competences, its own corporate sector and a deliberative body that scrutinises its decisions in public.
Three features shape municipal procurement in Portugal. First, contracting is spread across departments — works, environment, education, social action, information systems — and article 17-B requires the estimated values of contracts awarded by all organisational units to be aggregated, unless those units are independently responsible for their own acquisitions.
Second, the transfer of competences to municipalities under the decentralisation process brought schools, health centres and cultural facilities into municipal responsibility. The new special prior consultation procedure expressly covers works on properties transferred in that process, and public or cost-controlled housing.
Third, decisions are scrutinised by the municipal assembly, by the opposition, by local media and, downstream, by the Court of Auditors. Written justification is not a formality here; it is protection.
